To require the Secretary of Homeland Security to take into custody aliens who have been charged in the United States with theft, and for other purposes.
Though this Act, Congress has made it lawful for any “alien” criminally charged with theft to be arrested, if not by the State in which the criminal act occurs, then the Secretary of Homeland Security is required to do so.
The Act further grants any State’s Attorney General the ability to sue the Secretary of Homeland Security if it can be proven that the Secretary’s failure to take action, as expressed within the terms of this law, caused harm to the State, or its residents.
